WarmSystem OÜ, registration code 11960878 (hereinafter referred to as the Service Provider), and the client who places an order in the online store https://warmsystem.eu and identifies themselves by entering their personal data in the order form (hereinafter referred to as the Service User), have entered into this Internet Store Usage Agreement (hereinafter referred to as the Usage Agreement).
1. ONLINE STORE
1.1 The internet store warmsystem.eu (hereinafter referred to as the internet store) is an internet store created by the Service Provider through which the sale of goods to the Service User takes place.
1.2 warmsystem.eu is a registered trademark owned by the Service Provider.
2. GENERAL PROVISIONS
2.1. 2.1. The parties to the agreement govern their relations with each other in accordance with the Law of Obligations Act and other laws of the Republic of Estonia, as well as other legal acts and the provisions established in the Usage Agreement.
2.2. 2.2. The Service Provider has the right at any time to make changes to the offered internet store service.
2.3. 2.3. The Service Provider has the right to unilaterally change the terms of the usage agreement without the obligation to notify the Service User in writing by email.
3. PRODUCTS AND PURCHASING
3.1 Products displayed in the internet store are usually in stock. The availability of products displayed in the internet store may change due to technical issues in warehouse or internet store programs.
3.2 If the product is not in stock and the order cannot be fulfilled, an employee of the internet store contacts the user and offers a possible new delivery date or a replacement product of equal price and quality or a refund. Money is returned to the Service User promptly within reasonable time after the order is placed.
3.3 Product images are for illustrative purposes and may differ from the actual product. The product descriptions available in the internet store are not necessarily exhaustive and may contain unintentional errors.
3.4 The products offered in the internet store are sold to both physical and legal persons.
3.5 The Service User confirms that they have reached the age of 15.
3.6 The Service User selects the desired products and undertakes to enter the data required to execute the order (surname, first name, contact phone, email address, delivery address, postal code) and makes payment for the products through an internet bank using a banking link based on a prepayment invoice or fills out an application for purchase on installment.
3.7 When placing an order, the Service User undertakes to provide accurate data necessary for fulfilling the order. The Service Provider is not responsible for the failure to execute an order due to the Service User providing incorrect data or for any consequences arising therefrom.
3.8 The sale occurs when the Service User has sent the order via the internet store’s webpage and has also paid for the order.
3.9 Payments are made by Maksekeskus AS. Payments are accepted in euro via Swedbank, SEB, LHV, Luminor, Coop Pank, Poco pay.
3.10 WarmSystem OÜ is the responsible processor of personal data, WarmSystem OÜ transfers personal data necessary for making payments to the authorised processor Maksekeskus AS.
4. PRICES
4.1. 4.1. All prices in the internet store are indicated in euros and include sales tax.
4.2. 4.2. The Service Provider is entitled to change the prices listed in the internet store at any time. If the prices in the internet store are changed after the Service User has placed and paid for the order, the Service Provider undertakes to deliver the corresponding products at the prices that were valid at the time of the order. The Service User has no right to demand compensation for the price difference.
5. DELIVERY TERMS AND CONDITIONS
5.1 The Service User has the right to choose one of the presented methods of product delivery.
5.2 If the Service User has chosen delivery by courier, then the product is delivered by a courier within 1-14 working days. All shipments are insured until handed over to the client.
5.3 The ordered products are only handed over upon presentation of an identity document specified in the order belonging to the Service User. Handing over products to third parties is done only with the customer’s agreement.
Delivery time from 1 working day after placing the order (if the product is available at the representative office) to 14 days (if the product is available in the warehouse). The approximate delivery time is displayed on the product page.
warmsystem.eu offers several methods of product delivery: by DPD transport company and by Omniva transport company.
6. ORDER CANCELLATION
6.1 If the Service User wishes to withdraw from the contract after placing the order and before the contract has been performed by the Service Provider, the Service User is required to notify the Service Provider as quickly as possible in writing. Written notice should be sent to the email address info@warmsystem.eu. The email should include the order number and the Service User’s bank account and add the Service User’s contact information (name, surname, order placement date, contact phone). If desired, you can also use the following form to cancel the order:

– I hereby withdraw from the order () for the following product () / the following service (___)
– Order placement date () / product receipt date ()
– Consumer’s name
– Consumer’s address
– Consumer’s signature (only if this form is submitted on paper)

6.2 If the Service Provider receives the notice of withdrawal after the contract has been performed by the Service Provider, the withdrawal from the contract is in accordance with the “Right of Return” section of the Usage Agreement.
6.3 The Service Provider immediately refunds the paid amount to the Service User, but no later than 14 days after receiving the notice of withdrawal from the contract.
6.4 The money is transferred to the same account from which they were received by the Service Provider.
7. RIGHT OF RETURN
7.1 A right of return within 14 days applies to products purchased in the internet store.
7.2 The returned product must be undamaged, complete, and in its original packaging.
7.3 To return the product, notify via the email address info@warmsystem.eu
7.4 Upon contract cancellation, the consumer must immediately return the purchased product, but no later than 14 days after the notice of withdrawal from the contract.
7.5 In the case of a return, the money is transferred back to the Service User promptly, but no later than 14 days after receiving the notice of withdrawal from the contract.
7.6 The money is transferred to the same exact account from which it was received by the Service Provider.
7.7 The right of return within 14 days does not apply to products made according to the personal needs of the Service User.
8. PROCEDURE FOR MAKING CLAIMS
8.1 Regarding products sold in the internet store, there is a 2-year period for making claims established in part 2, section 218 of the Law of Obligations Act.
8.2 The handling of claims is conducted in accordance with the “Procedure for Handling Claims of WarmSystem OÜ”.
9. PERSONAL DATA AND THEIR USE
9.1 The Service User gives the Service Provider clear and informed consent to process their personal data.
9.2 Personal data of the Service User entered by the user when placing an order and known to the Service Provider are entered into the customer registry and used for providing sales services and offering products to the Service User.
9.3 The source of personal data is the establishment of customer relations when placing an order in the internet store.
9.4 The registered personal data include the order data of the Service User – personal identification code, surname, first name(s), street, house number, apartment number, village or city, postal code, phone number, address, year of birth, gender, delivery method used, payment method used, consent to the terms of the Usage Agreement, consent to receive sales offers, notes sent by email in free text.
9.5 Personal data necessary for delivering the product to the Service User are transferred to the company providing courier services.
9.6 Protection of personal data is ensured by all security measures required by law.
9.7 The Service Provider undertakes not to transfer registered personal data to third parties.
9.8 The Service Provider reserves the right to transfer personal data related to the Service User to persons who have the legal right to process the data for fulfilling legal obligations, as well as to persons who have the legal right and do so to protect the life, health, or freedom of the Service User or another person.
9.9 The Service User has the right to inspect the personal data related to him, as well as to amend or request the removal of his personal data from the register.
9.10 The Service User gives the Service Provider consent to send order confirmation to the email address specified during order placement.
10. LIABILITY
10.1 The Service Provider is liable within the price of the sold goods. The Service Provider does not accept liability for damages caused by defective products such as damage to property or information, loss of turnover or profit.
10.2 The Service User agrees to use the internet store service solely in accordance with the law and good practices.
10.3 The Service User bears all costs related to the acquisition and maintenance of data exchange systems, software used, equipment, as well as other services used from the internet store.
10.4 The Service User bears full responsibility for damages caused to the Service Provider, other Service Users, or third parties as a result of using the internet store in a manner contrary to the terms of the Usage Agreement, the law, or good practices.
11. DISPUTES
11.1 Disputes arising between the Service User and the Service Provider under the Usage Agreement are resolved according to the legal acts in force in the Republic of Estonia. If an agreement is not reached, disputes are resolved in Harju County Court.
11.2 In the Republic of Estonia, the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (https://komisjon.ee/et) is the body for out-of-court settlements of complaints. The committee is competent to resolve disputes arising from a contract between a consumer and a seller. The processing of a complaint by the Committee is free of charge.
12. USAGE TERMS
12.1 Familiarization with the conditions set forth in the Usage Agreement is mandatory for the Service User.
12.2 By marking “I agree to the privacy policy and purchase conditions” at the time of placing the order, the Service User agrees that he has read, understood, and agrees with the conditions set in the Usage Agreement.
